Terms and Conditions


Interpretation
The definitions and rules of interpretation in this condition apply in these Terms and Conditions
(Conditions):
Centre: the centre at which the to purchase the Services specified in it on these Conditions. Services will be provided , including where relevant, the entire site and grounds on which the Centre is located.
Contract: the Client’s Student Information form, the Acknowledgment and the Partnership Agreement.

 

Course: the course (consisting of one or more courses of tuition) referred to in the Acknowledgment to be provided by Fast Forward Tuition as part of the Services.

Client: the person purchasing the Services from Fast Forward Tuition under the Contract. Partnership Agreement: An agreement accepted by the Client and the Student by applying for and attending a Fast Forward Tuition’ course.
Tutor: The Fast Forward Tuition representative or representatives on the Course and/or at the Centre. Services: The Course to be provided by Fast Forward Tuition under the Contract, as confirmed in the
Acknowledgment, together with any other services which Fast Forward Tuition provides, or agrees to provide. Student: the individual referred to in the Acknowledgment as attending the Course. Headings in these Conditions will not affect their interpretation. Words in the singular include the plural (and vice versa), and a reference to one gender includes a reference to the other genders. Any obligation in the Contract on a person not to do something includes, without limitation, an obligation not to agree, allow, permit or acquiesce in that thing being done. Any obligation in the Contract on the
Client will include, without limitation and where relevant, an obligation on the Client to ensure that the Student also complies with that obligation.
References to conditions are to the conditions of the Contract.

 

Application of Conditions and Cancellation of Contract
These Conditions will:
Apply to and be incorporated into the Contract;
and prevail (where relevant, to the fullest extent permissible by law) over any inconsistent terms or conditions contained, or referred to, in any other document supplied by the Client, or implied by law, trade
custom, practice or course of dealing. The Client's Student Information form constitutes an offer by the Client to purchase the Services specified in it on these Conditions. No offer placed by the Client will be accepted by Fast Forward Tuition other than; by a written acknowledgement issued and executed by Fast Forward Tuition; or (if earlier) by FastForward Tuition starting to provide the Services, when a contract for the supply and purchase of the
Services on these Conditions will be established.
Once payment for the Course has been received, FastForward Tuition will issue a payment receipt to the Client.

 

Changes to the Courses Booked
Fast Forward Tuition reserves the right from time to time to make changes to the Course booked. If this becomes necessary, Fast Forward Tuition will give the Client as much notice as possible of such changes and will discuss them with the Client.

 

Changes to Centre
Fast Forward Tuition reserves the right from time to time to change the Centre where the Course (booked or otherwise) is to take place, by substituting it with another Centre, located within a reasonable distance of the original Centre. If this becomes necessary, Fast Forward Tuition will give the Client as much notice as possible of such change and will discuss them with the Client.
Unless Fast Forward Tuition has agreed in advance in writing, only a Student will be permitted to attend the Course, and the right to attend the Course may not be transferred or assigned to any other person. In accordance with Fast Forward Tuition’ aim to teach on a "topic" or "exam board" basis, classes will
sometimes contain students preparing for exams set by more than one exam board and FastForward Tuition fully reserves the right to organise classes on this basis. For the avoidance of any doubt, the Services do not entitle the Student to personal tuition, but to attend a Course, which will take place within a class of students, which will include the Student. Whilst Fast
Forward Tuition will request the Tutor to use their reasonable endeavours to devote a reasonable amount of time to each student in the class, given the nature of teaching and the fact that different students are
likely to have different levels of knowledge, Fast Forward Tuition will not be responsible for, nor liable to, the Client and/or the Student, should the class tutor be unable to devote an equal amount of time to each
student.


Provision of the Services

Fast Forward Tuition does not take responsibility for missed course attendance by students due to unreliable transport or poor weather. During the course, each Tutor will keep abreast of current weather conditions, the forecast and have an understanding of associated risks. Whilst it is the individual student’s prerogative to leave early, ultimately FastForward Tuition will decide on the appropriate course of action. If a Tutor fails to attend the course entirely, Fast Forward Tuition will use best endeavours to provide a suitable and timely alternative group tutoring solution. If this isn’t possible a credit note for a further course or single class will be issued or Fast Forward Tuition will reimburse the full cost of the course or single class.
Any issue or query that the Client and/or the Student has at any stage during a Course, with any aspect of the Course, should be brought at the earliest possible opportunity to the attention of the Tutor and Fast
Forward Tuition to give them an opportunity to try and resolve the same. No action can be taken in respect of any matter which is not notified at such time, and, as such, Fast Forward Tuition will be unable to address, and will not be liable or responsible in respect of, any such matter. Without limitation to, given the nature of the Services and the numerous factors and variables involved,
including without limitation, the Student’s level of ability when attending the Course, for the avoidance of any doubt, Fast Forward Tuition gives no guarantee, warranty, assurance or undertaking and makes no
representation or otherwise, that following the provision of the Services and/or the Student’s attendance on any Course, the Student will have any particular level of knowledge, or pass, or achieve any particular
grade or mark in, any examination or test, or attain any particular level of achievement, or otherwise.

 

Client’s Obligations
If Fast Forward Tuition’s performance of its obligations under the Contract is prevented or delayed by any act or omission of the Client and/or the Student, Fast Forward Tuition will not be liable for any costs,
charges or losses sustained or incurred by the Client arising directly or indirectly from such prevention or delay. The Client will be liable to pay to Fast Forward Tuition, on demand, all reasonable costs, charges or losses sustained or incurred by Fast Forward Tuition (including, without limitation, any direct, indirect or consequential losses, loss of profit and loss of reputation, loss or damage to property and those arising from injury to or death of any person and loss of opportunity to deploy resources elsewhere) arising directly or indirectly from the Client's negligence, failure to perform or delay in the performance of any of its obligations under the Contract. The Client will be liable to pay to Fast Forward Tuition, on demand, all reasonable costs sustained or incurred by Fast Forward Tuition arising directly or indirectly from the Student’s breaking or taking any item from the Centre, subject to Fast Forward Tuition confirming such costs to the Client in writing.

 

Agreement with the Tutor for the provision of tutoring services
By applying for a course with Fast Forward Tuition, the Client agrees to be bound by the terms and conditions attached with the Tutor for the provision of tutoring services. The agreement governs the relationship between the Client and the Tutor.
The Client is not permitted to make any private or other arrangements with the Tutor who has been introduced by Fast Forward Tuition.
Clients will notify Fast Forward Tuition if they introduce another Client to a Tutor. A breach of these terms will render the Client liable to Fast Forward Tuition for any sums paid direct to the
Tutor without deduction and Fast Forward Tuition shall be entitled to seek an injunction against the Client to prevent further breaches. This obligation continues beyond the termination or conclusion of this agreement.

 

Client Responsibilities
Clients must reveal all pertinent information about a Student such as medical history, record of misconduct, legal matters or any family circumstances that may affect a Student’s educational progress or the welfare of others involved on the course.
Clients should notify Fast Forward Tuition in writing of any changes in circumstances or any information which would assist a Tutor. This includes any change in contact details. Fast Forward Tuition cannot be
held responsible for not being able to contact Clients on the numbers and address they have supplied. Clients are responsible for arranging any appropriate insurance cover for Students, e.g. medical, travel, sickness and personal injury, should they consider that necessary.
Clients are legally liable for the full payment of all invoices and any other expenses incurred on behalf of a Student.
Fast Forward Tuition and a Tutor shall not be liable for loss or damage to personal property however caused.

 

Adherence to Guidelines

Fast Forward Tuition reserves the right to withdraw a Student for any behaviour which might be considered detrimental to the smooth running of the Course or which might interfere with the studies of other Students. Any refund of fees will be at the sole discretion of Fast Forward Tuition.
Clients undertake to ensure Students are receptive to this guidance and will follow instructions. Fast Forward Tuition will not accept responsibility for the consequences of any action by a Student which
contravenes given guidance. All Students should respect other students and the tutor(s); not use mobile phones during lessons; be
punctual; co-operate fully with tutors and prepare all work/homework set by them. Consumption of alcoholic beverages, smoking or substance abuse, will result in immediate dismissal from the course.

 

Medical Conditions, Disabilities, Allergies
The Client must disclose in the Student Information form (in sufficient detail for Fast Forward Tuition to be able to reasonably understand the nature and extent of the same) details of any medical condition or disability suffered by the Student and/or any medication being taken by the Student, and in particular any medical condition or disability which will or may affect the Student, and/or medication being taken by the Student, while attending the Course and/or at the Centre. Fast Forward Tuition will not be responsible for,
and/or liable to, the Client and/or the Student, in respect of any such matter which has not been properly disclosed to Fast Forward Tuition.
Tutors may not have specific medical training and Fast Forward Tuition does not provide a medical service or facilities at any of the Centre. Centres may not be equipped or have facilities, for disabled students. Details of a Student’s disability must be drawn to Fast Forward Tuition’ attention at the time of
applying and Fast Forward Tuition will confirm whether it is has the facilities to accept and/or accommodate the Student at the relevant Centre. Fast Forward Tuition cannot administer, dispense or store any medication at any time, at the Centre, and/or assist the Student without written consent from
the Client (parent). Any such matters must be discussed with Fast Forward Tuition at the time that Student Information form is completed at which time Fast Forward Tuition will confirm what special arrangements, if any, it is able to make, to try and accommodate the relevant matter, without being
obliged to make any such special arrangements. Fast Forward Tuition will make no special arrangements unless it confirms in writing that it will do so.
The Client must disclose in the Student Information form (in sufficient detail for Fast Forward Tuition to be able to reasonably understand the nature and extent of the same) details of any allergies and/or reactions suffered by the Student, including, without limitation, severe food allergies and/or reactions, and in
particular any allergies and/or reactions which will or may affect the Student’s attendance on the Course and/or at the Centre. Fast Forward Tuition will not be responsible for, and/or liable to, the Client and/or the Student, in respect of any such matter which has not been properly disclosed to Fast Forward Tuition. Any such matters must be discussed with Fast Forward Tuition at the time that the Student Information Form is completed at which time Fast Forward Tuition will confirm what special arrangements, if any, it is
able to make, to try and accommodate the relevant matter, without being obliged to make any such arrangements. Fast Forward Tuition will make no special arrangements unless it confirms in writing that it will do so.

 

Photography and Film Consent
From time to time, FastForward Tuition will take photos and film footage of students to be used in film presentations on courses. FastForward Tuition may also use footage on our website and media platforms to promote future courses. We will not use the name of any children in photo or film captions. By signing and returning the Student Information Form, Clients hereby give permission for FastForward Tuition to take and use photographs and/or digital images of Students for use in printed publications or materials,
electronic publications and website.

 

Discretion
The Tutor will endeavour to exercise a duty of care. Any specific restrictions needed to be placed upon a student, should be given in writing prior to the commencement of the tuition. A Tutor will exercise discretion in respect of a Student’s welfare when unable to contact the Client. The signed Student Information Form authorizes a Tutor to agree to any emergency medical treatment such as a blood transfusion, an anaesthetic or an operation, as deemed immediately necessary for a Student’s welfare by suitability qualified medical personnel. This right will only be exercised if it has not
been possible to obtain a Client’s prior consent.

 

The Student’s Property
Fast Forward Tuition recommends that the Student does not bring valuables to the Centre. It is the Student’s sole responsibility to take care of all of their personal possessions, property and valuables. Fast
Forward Tuition will not be responsible for and/or liable to the Client and/or the Student for any personal possessions, property or valuables of the Client and/or the Student which are lost or stolen while on the Course and/or at the Centre.

 

Fast Forward Tuition’ Property
All materials, equipment and papers, supplied by or on behalf of Fast Forward Tuition to the Client and/or to the Student will, at all times, unless Fast Forward Tuition confirms otherwise, be and remain the
exclusive property of Fast Forward Tuition, but will be kept safely by the Client and/or Student until returned to Fast Forward Tuition, and will not be disposed of nor used other than in accordance with FastForward Tuition's instructions or authorisation.

 

Limitation of Liability
This condition sets out the entire financial liability of Fast Forward Tuition (including any liability for the acts or omissions of its tutors) to the Client in respect of:
(a) any breach of the Contract;
(b) any use made by the Client and/or the Student of the Services, or any part of them; and
(c) any representation, statement or tortuous act or omission (including negligence) arising under or in
connection with the Contract.
All warranties, conditions and other terms implied by statute or common law are, to the fullest extent
permitted by law, excluded from the Contract, provided that nothing in the Contract will affect, or is
intended to affect, the Client’s statutory rights.
Nothing in these Conditions limits or excludes the liability of Fast Forward Tuition:
(a) for death or personal injury resulting from negligence; or
(b) for any damage or liability incurred by the Client as a result of fraud or fraudulent misrepresentation by
Fast Forward Tuition; or
(c) for any liability incurred by the Client as a result of any breach by Fast Forward Tuition of any term
implied by law which it is not permissible to exclude.
(a) Fast Forward Tuition will not be liable for:
(i) loss of profits; or
(ii) any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.
(b) Fast Forward Tuition' total liability in contract, tort (including negligence or breach of statutory duty),
misrepresentation, restitution or otherwise arising in connection with the performance, or contemplated
performance, of the Contract will be limited to the price paid for the Services.

 

Enrolment
Every Student, subject to satisfying the admission criteria, will be enrolled on the course once the Registration Form and the deposit and fees for the period stipulated have been paid in full. Fast Forward Tuition cannot guarantee the availability of selected options.

 

Finance
Clients are responsible of the payment of deposit and course fees

 

Fees
The Deposit and course fees cover the period of the course timetabled by Fast Forward Tuition according to the number of lessons that have been determined.

 

Payment Policy
Deposit and course fees must be settled in full prior to course on the agreed date on invoice. If the funds are not received in the stipulated time the entitlement to tuition may lapse and a Student may
not be able to take part in a course. This means that a Tutor’s responsibilities will be suspended until full payment has been received and the funds have cleared. Any part payment will only be accepted on
account and will neither maintain nor reinstate the service with a Tutor.

 

Refund Policy
Fees and deposits are non-refundable, unless otherwise decided by Fast Forward Tuition. A minimum number of students are required for classes to be viable. Should there be less than the minimum, Fast Forward Tuition will contact a Client to discuss an alternative arrangement option or
provide a full refund. Clients and Students will not be eligible for any refund should they contravene the guidance outlined.

 

Absence and Sickness
Clients must inform the course tutor if a student is unavailable for a class. Fees are non-refundable in this instance, unless Fast Forward Tuition decides otherwise. Any student with an infectious condition such as sickness or diarrhoea which has occurred within 24 
hours of the commencement of the course is considered unfit to attend the course. Fees are non- refundable in this instance, unless Fast Forward Tuition decides otherwise.

 

Age
A Client who is under 18 years of age must have consent from a parent or a guardian to contact Fast Forward Tuition and their parent or guardian must enter into any agreement with Fast Forward Tuition to
provide tuition services. It is the responsibility of that parent/guardian to check the credentials of the Tutor. Fast Forward Tuition is not responsible for any disputes regarding parental consent.

 

Termination of the Contract

Fast Forward Tuition and a Tutor reserve the right to relinquish responsibilities without due notice if important information about a Student has been withheld or in the event of serious misconduct. Whilst Fast Forward Tuition are not bound by any set notice period, whenever possible, notifications of any such
decision will be given in writing to Clients prior to the termination taking place.
Should clients pick students after the time stipulated, Fast Forward Tuition reserves the right to refuse the client future entry to classes without refund.
To secure the continuity of the service provision, all payment must be made in full within the time stipulated. To withdraw a Student from a Fast Forward Tuition course, notice is required in writing. This means giving
Fast Forward Tuition and Tutors 7 days' notice prior to the commencement of the course. Fees in this instance are non-refundable.

 

Force Majeure
Fast Forward Tuition will have no liability to the Client under the Contract if it is prevented from, or delayed in performing, its obligations under the Contract or from carrying on its business by acts, events, omissions or accidents beyond its reasonable control, including (without limitation), strikes, lock-outs or, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or fault of agents or subcontractors.

 

Variation
Fast Forward Tuition may, from time to time and without notice, change the Services in order to comply with any applicable safety or statutory requirements, provided that such changes do not materially affect
the nature, scope of, or the charges for the Services.

 

Waiver
A waiver of any right under the Contract is only effective if it is in writing and it applies only to the circumstances for which it is given. No failure or delay by Fast Forward Tuition in exercising any right or remedy under the Contract or by law will constitute a waiver of that (or any other) right or remedy, nor
preclude or restrict its further exercise. No single or partial exercise of such right or remedy will preclude or restrict the further exercise of that (or any other) right or remedy. Unless specifically provided otherwise, rights arising under the Contract are cumulative and do not
exclude rights provided by law.

 

Severance
If any provision of the Contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision will, to the
extent required, be deemed not to form part of the Contract, and the validity and enforceability of the other provisions of the Contract will not be affected.

 

Entire Agreement
The Contract constitutes the whole agreement between the parties and supersedes all previous agreements between the parties relating to its subject matter. The Client acknowledges that, in entering into the Contract, they have not relied on, and will have no right or remedy in respect of, any statement, representation, assurance or warranty (whether made negligently
or innocently) (other than for breach of contract), as expressly provided in the Contract. Nothing in this condition will limit or exclude any liability for fraud.

 

Disclosure of Information
By receiving this agreement, a Client agrees to allow us to:
Communicate confidential information to any third-party on a “need-to-know” basis should it be required to safeguard and promote the welfare of a Student or another person from any harm inflicted by a
Student. Disclose to any person lawfully requiring details about a Student, information stored or retained by us to which the Data Protection Act 1998 or similar legislation applies.

 

Assignment
The Client will not, without the prior written consent of Fast Forward Tuition, assign, transfer, charge, mortgage, subcontract or deal in any manner with all or any of their rights or obligations under the Contract.
Fast Forward Tuition may at any time assign, transfer, charge, mortgage, subcontract or deal in any other manner with all or any of its rights under the Contract and may subcontract or delegate in any manner any or all of its obligations under the Contract to any third party or agent.

 

Rights of Third Parties
A person who is not a party to the Contract will not have any rights under or in connection with it.

 

Notices
Any notice required to be given under the Contract will be in writing either by email or post to the other party, in the case of the Client to the address specified in the Acknowledgment. Any notice will be deemed to have been duly received, in the case of a notice sent within the UK, on the
second Working Day after posting, or, in the case of a notice sent from one country to another, on the fifth
Working Day after posting (where the recipient is not in the UK, a Working Day being a day generally
classified as a working day in that country). In the case of an email, it will be within one working day.

 

Governing Law and Jurisdiction
The Contract, and any dispute or claim arising out of or in connection with it or its subject matter, will be governed by, and construed in accordance with, the law of England and Wales. The parties irrevocably agree that the courts of England and Wales will have exclusive jurisdiction to settle
any dispute or claim that arises out of, or in connection with, the Contract or its subject matter.

 

Data protection policy
The information gathered from and about Tutors and Clients is solely used by FastForward Tuition for the services that it provides. When Tutors provide FastForward Tuition with information, they consent to
FastForward Tuition using this information to arrange introductions to Clients as well as being able to contact them. Clients also accept that when providing FastForward Tuition with information, they consent
to FastForward Tuition using this information to arrange introductions to Tutors as well as being able to contact them in the future for legitimate reasons, relevant to them. Tutors accept that when providing
FastForward Tuition with information, they consent to FastForward Tuition using this information toarrange introductions to Clients as well as being able to contact them in the future for legitimate reasons,
relevant to them. Please see our updated privacy policy, available on request and on our website.

 

Safeguarding Policy
FastForward Tuition makes a positive contribution to a strong and safe community and recognises the right of every individual to stay safe.
FastForward Tuition comes into contact with children and / or vulnerable adults through the following activities: tuition services.
The types of contact with children and / or vulnerable adults will be regulated and controlled activity. This policy seeks to ensure that FastForward Tuition undertakes its responsibilities with regard to protection of children and / or vulnerable adults and will respond to concerns appropriately. The policy
establishes a framework to support Tutors in their practices and clarifies the organisation’s expectations.

 

Website Terms
FastForward Tuition does not provide any guarantee that the content on this website is accurate nor does FastForward Tuition offer any warranty about the suitability of the content shown on this website or any
documents produced by FastForward Tuition. The user of the website is fully aware that the information provided by FastForward Tuition might be inconsistent and also that FastForward Tuition openly exclude
liability for any mistakes to the fullest extent permitted. FastForward Tuition is not liable for any third party website links. Users of the website accept that occasionally the website will be off-line for repairs. All
content on the website is property of FastForward Tuition.
The name FastForward Tuition and the website www.fastforwardtuition.co.uk are the sole property of FastForward Tuition and must not be used without the prior consent of FastForward Tuition. All goodwill which accrues in the name, website and logo remains the sole property of FastForward
Tuition. FastForward Tuition reserves the right to be able to change these terms and conditions whenever they so wish. These terms and conditions shall prevail over any other terms and conditions. The Client and the Tutor hereby confirm that both have read, understood and agree to comply where
relevant with all FastForward Tuition’ policies and terms and conditions.

FastForward tuition was founded by experienced local teachers, Tom and Cathy. They are both highly-qualified practitioners and have years of experience across both primary and secondary level, preparing students for the 11+, Common Entrance, SATs, GCSEs and A-levels.
